By accessing and using the services provided by Reliable Home Protection ("Company," "we," "our," or "us"), you ("Customer," "you," or "your") agree to be bound by these Terms and Conditions ("Terms"). These Terms constitute a legally binding agreement between you and Reliable Home Protection.

If you do not agree to these Terms, you may not use our services or access our website. Your continued use of our services after any modifications to these Terms constitutes your acceptance of the revised Terms.

Important: These Terms supplement and do not replace your specific service agreement or warranty contract with Reliable Home Protection.

Services Description

Home Protection Services

Reliable Home Protection provides comprehensive home warranty and protection services for residential properties in California. Our services include but are not limited to:

  • HVAC Protection: Heating, ventilation, and air conditioning system coverage
  • Plumbing Protection: Water lines, fixtures, and plumbing system coverage
  • Electrical Protection: Electrical system and component coverage
  • Appliance Protection: Major home appliance warranty coverage
  • Water Heater Protection: Water heating system coverage
  • Roofing Protection: Roof system and repair coverage
  • Garage Door Protection: Garage door and opener coverage
  • Pool & Spa Protection: Pool and spa equipment coverage
  • Pest Control Protection: Pest management and control services
  • Security Systems: Home security equipment coverage

Service Delivery

Services are provided through our network of licensed, certified technicians and contractors. We maintain quality standards and ensure all service providers meet our requirements for licensing, insurance, and professional competency.

Emergency Services

We provide 24/7 emergency service for covered items that pose immediate safety risks or cause significant property damage. Emergency response times vary by location and availability of technicians.

Eligibility Requirements

Property Eligibility

To be eligible for our services, your property must meet the following criteria:

  • Located within our California service areas
  • Primarily used as a residential dwelling
  • Systems and appliances in working condition at time of enrollment
  • Property must pass initial inspection (if required)
  • Compliance with local building codes and regulations

Customer Eligibility

Customers must:

  • Be at least 18 years of age
  • Be the property owner or have legal authority to enter into service agreements
  • Provide accurate and complete information during enrollment
  • Maintain current contact information and payment methods

Exclusions

The following properties are not eligible for coverage:

  • Commercial or business properties
  • Vacant or unoccupied homes (more than 30 consecutive days)
  • Properties under construction or major renovation
  • Properties with known pre-existing conditions (unless disclosed and accepted)
  • Properties in areas not served by our technician network

Coverage Terms and Conditions

Coverage Effective Date

Coverage begins on the effective date specified in your service agreement, typically 30 days after enrollment and payment of the first month's fee. Some services may have different waiting periods as specified in your contract.

What's Covered

We cover the repair or replacement of covered systems and appliances that fail due to normal wear and tear. Coverage includes:

  • Parts and labor for covered repairs
  • Replacement when repair is not economically feasible
  • Emergency service calls for covered items
  • Diagnostic services for covered systems

What's Not Covered

The following are excluded from coverage:

  • Pre-existing conditions known at time of enrollment
  • Damage due to misuse, abuse, or negligence
  • Cosmetic damage that doesn't affect functionality
  • Damage from natural disasters, floods, or earthquakes
  • Code upgrades or improvements beyond original specifications
  • Routine maintenance and cleaning
  • Items beyond their useful life expectancy
  • Damage from power surges or electrical issues

Coverage Limits

Coverage is subject to annual and per-incident limits as specified in your service agreement. We reserve the right to replace rather than repair items when replacement is more cost-effective.

Payment Terms

Service Fees

You agree to pay all fees associated with your service plan, including:

  • Monthly or annual service plan fees
  • Service call fees (if applicable)
  • Trade call fees for non-covered items
  • Additional fees for services outside standard coverage

Payment Methods

We accept the following payment methods:

  • Credit cards (Visa, MasterCard, American Express, Discover)
  • Debit cards
  • Electronic bank transfers (ACH)
  • Checks (for annual payments)

Billing and Collection

Fees are billed in advance according to your chosen payment schedule. Late payments may result in:

  • Late fees as specified in your service agreement
  • Suspension of service coverage
  • Termination of service agreement
  • Collection activities

Refunds

Refunds are provided according to our refund policy as outlined in your service agreement. Generally, refunds are prorated for unused service periods, minus any claims paid and administrative fees.

Claims Process

Filing a Claim

To file a service claim, you must:

  1. Contact our customer service department by phone, email, or online portal
  2. Provide detailed information about the problem
  3. Allow access to the property for inspection and service
  4. Cooperate with our technicians and service providers

Claim Processing

Upon receiving your claim, we will:

  • Verify coverage under your service agreement
  • Schedule a diagnostic visit if necessary
  • Authorize appropriate repairs or replacement
  • Coordinate service with our approved technicians

Customer Responsibilities

You are responsible for:

  • Providing reasonable access to the property
  • Being present during service visits when required
  • Protecting personal property during service
  • Reporting problems promptly to prevent further damage
  • Following proper maintenance procedures

Service Standards

We strive to provide timely, professional service. Response times vary based on:

  • Urgency of the situation
  • Availability of technicians
  • Geographic location
  • Weather and other external factors

Limitations and Exclusions

Service Limitations

Our services are subject to the following limitations:

  • Coverage is limited to items specifically listed in your service agreement
  • Annual and per-incident benefit limits apply
  • Service is provided during normal business hours unless emergency conditions exist
  • Replacement items may be of similar quality but not necessarily the same brand or model
  • We reserve the right to choose repair versus replacement

Geographic Limitations

Services are available only within our designated California service areas. Remote locations may have extended response times or additional service charges.

Technician Availability

Service is subject to technician availability. During peak demand periods, response times may be extended. We do not guarantee specific technicians or service times.

Force Majeure

We are not responsible for delays or inability to perform services due to circumstances beyond our control, including but not limited to:

  • Natural disasters
  • Government actions or regulations
  • Labor strikes or disputes
  • Supply chain disruptions
  • Pandemic or health emergencies

Termination

Termination by Customer

You may terminate your service agreement:

  • At any time with 30 days written notice
  • Immediately if we materially breach these Terms
  • During any renewal period according to your contract terms

Termination by Company

We may terminate your service agreement:

  • For non-payment of fees after proper notice
  • For material breach of these Terms
  • For fraudulent claims or misrepresentation
  • If property becomes ineligible for coverage
  • For abusive or threatening behavior toward our staff

Effect of Termination

Upon termination:

  • Coverage ends on the termination date
  • No refunds for partial months unless required by law
  • Outstanding claims may be processed according to contract terms
  • All payment obligations remain in effect

Limitation of Liability

Disclaimer of Warranties

EXCEPT AS EXPRESSLY PROVIDED IN YOUR SERVICE AGREEMENT, WE PROVIDE SERVICES "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO OUR SERVICES SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU FOR SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM.

Exclusion of Consequential Damages

WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Loss of profits or business opportunities
  • Property damage beyond covered items
  • Personal injury (except as required by law)
  • Emotional distress or inconvenience
  • Loss of use of property

Indemnification

You agree to indemnify and hold harmless Reliable Home Protection from any claims, damages, or expenses arising from your misuse of services or violation of these Terms.

Dispute Resolution

Informal Resolution

Before pursuing formal dispute resolution, we encourage you to contact our customer service department to resolve any issues informally. Many disputes can be resolved quickly through direct communication.

Arbitration

Any disputes that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Los Angeles County, California.

Class Action Waiver

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as part of a class action, collective action, or representative proceeding.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
